Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Curator website ("Site") and mobile application ("App") operated by Curator ("Curator," "we," "us," or "our"). By accessing or using the Site or App, you agree to be bound by these Terms. If you do not agree, do not use the service.

These Terms apply whether or not you create an account.

1. CHANGES TO TERMS

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice through the Site, App, or other appropriate means. Your continued use of the service after the effective date of updated Terms constitutes acceptance of those changes.

2. ELIGIBILITY

You must be at least 13 years old to use the Site or App. By using the service, you represent and warrant that you meet this requirement.

3. DESCRIPTION OF THE SERVICE

Curator provides a service that allows users to submit content from third-party sources (including social media posts, articles, links, or manual requests) for the purpose of organizing, formatting, and presenting that content in a more accessible and user-friendly format (such as recipes, workout routines, travel recommendations, or product summaries).

Curator does not claim ownership of third-party content and does not create original source material. Where possible, original creators are cited.

4. USER ACCOUNTS AND SECURITY

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use.

You may update your account information at any time through your account settings.

5. USER SUBMITTED CONTENT

User Representations

You represent and warrant that:

• You own or have the necessary rights and permissions to submit the content you provide.
• Your submission and Curator's permitted use of such content do not violate any law or infringe the rights of any third party.
• You will not submit content that is private, confidential, or subject to access restrictions unless you are authorized to do so.

6. PROHIBITED CONDUCT

You agree not to:

• Use the service for any unlawful purpose.
• Submit content that is harmful, offensive, or infringes the rights of others.
• Interfere with or disrupt the operation of the Site or App.
• Attempt to gain unauthorized access to Curator systems or data.

7. INFORMATION WE COLLECT AND USE

We collect and use information to operate and improve the service, including:

Personal Information

When you register, we may collect your name and email address. If you contact us via social media, we may collect your associated username.

Usage and Analytics Data

We use analytics tools such as Google Analytics and Firebase to collect aggregated usage data for performance monitoring and service improvement.

Preferences and AI Processing

We may collect user preferences (such as dietary preferences or injuries) to personalize results. Non-identifying preference data may be processed using third-party artificial intelligence or language model providers solely to deliver and improve the service. Personal identifiers are not intentionally shared for model training purposes unless explicitly disclosed.

8. DATA SECURITY AND RETENTION

We implement reasonable administrative and technical safeguards to protect your information.

If you delete your account or request deletion of your personal data, we will remove it from our active systems within approximately 30 days, subject to legal, security, or operational retention requirements.

9. HEALTH, FITNESS, AND NUTRITION DISCLAIMER

Curator does not provide medical, health, fitness, or nutritional advice. Any workouts, exercises, dietary information, or related content presented through the service are provided for informational and organizational purposes only, based on content submitted by users or third-party creators.

You acknowledge that physical activity involves inherent risk and agree that you are solely responsible for determining whether any activity is appropriate for you. You should consult a qualified healthcare professional before engaging in any exercise or dietary program.

Curator disclaims all liability for injuries, health conditions, or damages arising from your reliance on or use of such content.

10. INTELLECTUAL PROPERTY

All Curator-owned content, features, functionality, software, logos, and branding are the property of Curator or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted, no portion of the service may be copied, reproduced, or distributed without written permission.

11. DISCLAIMER OF WARRANTIES

The Site and App are provided "as is" and "as available." Curator disclaims all warranties of any kind, whether express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Curator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

Curator's total liability for any claim shall not exceed the greater of (a) $100 USD or (b) the total amount paid by you to Curator in the twelve (12) months preceding the claim.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Curator and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the service or violation of these Terms.

14. TERMINATION

We may suspend or terminate your access to the Site or App at any time if we reasonably believe you have violated these Terms or engaged in conduct harmful to the service or other users. Upon termination, your right to use the service will immediately cease.

15. ARBITRATION AND CLASS ACTION WAIVER

Binding Arbitration

Any dispute arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Location

Unless otherwise agreed, arbitration will take place in the United States, in a location designated by Curator.

Class Action Waiver

You and Curator agree that claims must be brought in an individual capacity and not as part of any class, collective, or representative action.

Opt-Out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@trycurator.ai with your name and a clear statement of your intent to opt out.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

17. THIRD-PARTY SERVICES

The service may integrate with third-party platforms and tools. Your use of those services is subject to their respective terms and privacy policies.

19. SURVIVAL
